This website is operated by 19/99 Beauty (“19/99 Beauty,” “we,” “us,” “our”). By visiting the site or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including any policies referenced or linked here (collectively, the “Service”). If you do not agree, do not use the Service. We may update these Terms from time to time by posting a new version on the Site.
Our store is hosted on Shopify Inc., which provides the ecommerce platform.
1. ONLINE STORE TERMS
You confirm you are at least the age of majority in your state of residence, or you are the age of majority and consent to minors using the Site under your supervision. You may not use the Service for any unlawful purpose or violate any applicable laws. You must not transmit viruses or malicious code. Breach of these Terms may result in termination.
2. GENERAL CONDITIONS
We may refuse or cancel Service as permitted by law, including for suspected fraud or abuse. Content (excluding payment data) may be transferred unencrypted and adapted to technical requirements. Payment card data is encrypted during transfer. You agree not to reproduce, sell, or exploit the Service without our written permission. Headings are for convenience only.

Site content is provided for general information and may not be current or complete. We may modify content at any time with no obligation to update.
4. MODIFICATIONS TO SERVICE & PRICES
Prices may change without notice. We may modify or discontinue the Service at any time. We are not liable for any modification, price change, suspension, or discontinuance.
5. PRODUCTS & SERVICES
Some products may be available exclusively online and in limited quantities, subject to our Return & Refund Policy. We try to display colors and images accurately but cannot guarantee your monitor’s display. We may limit sales or quantities, change descriptions or prices, or discontinue products at any time. Offers are void where prohibited. We do not warrant that products will meet your expectations or that errors will be corrected.
6. ORDERS; BILLING; ACCOUNT INFORMATION
We may accept, refuse, or cancel any order, limit quantities per person/household/account/card/address, and restrict reseller orders. If we change or cancel an order, we may attempt to notify you via the email/phone/billing address provided.

7. PRICING, TAXES & RISK OF LOSS
Prices are shown in the currency indicated and exclude taxes and shipping unless stated otherwise. Applicable sales tax (U.S.), GST/HST (Canada), or VAT (U.K.) is calculated at checkout based on your shipping address. Title and risk of loss transfer to you upon delivery by the carrier to the address you provide.
8. FRAUD SCREENING & ORDER ACCEPTANCE
All orders are subject to review and acceptance. We may use third-party tools to assess risk and may require additional verification or cancel orders we suspect are fraudulent or unauthorized.
9. OPTIONAL TOOLS & THIRD-PARTY SERVICES
We may provide access to third-party tools “as is” and “as available” without warranties or endorsement. Your use is at your own risk and subject to the third party’s terms. Third-party links may lead to sites we do not control; we are not responsible for their content or practices.
10. USER CONTENT (REVIEWS, PHOTOS, COMMENTS)
If you submit content (e.g., reviews, photos, social posts you tag with #1999beauty), you grant 19/99 Beauty a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such content in any media, including for marketing. You represent that you own or have permission to grant this license and that your content is lawful, accurate, and non-infringing. We may monitor, edit, or remove content in our discretion.
11. INTELLECTUAL PROPERTY; DMCA
All Site content (including text, graphics, logos, product names, and code) is owned by or licensed to 19/99 Beauty and protected by IP laws. If you believe content infringes your copyright, send a DMCA notice to:

13. PROMOTIONS, COUPONS & GIFT CARDS
Promotions and coupons are subject to the stated terms and cannot be combined unless expressly allowed. We may limit or revoke offers at any time. Gift cards are issued in accordance with applicable law and our gift-card terms, are not reloadable, refundable, or redeemable for cash (except as required by law), and cannot be replaced if lost or stolen.
14. SUBSCRIPTIONS & AUTO-RENEWALS (if offered)
If you purchase a subscription, it will auto-renew at the stated interval at the then-current price until canceled. By subscribing, you authorize recurring charges to your payment method. You can cancel before the next renewal in your account or by contacting us at hello@1999beauty.com. We will provide any legally required renewal notices.
15. PROHIBITED USES
In addition to other prohibitions in these Terms, you may not use the Site or its content for unlawful purposes; to violate laws; infringe IP rights; harass, defame, or discriminate; submit false information; upload malware; collect others’ personal information; spam/phish/scrape; or interfere with security features. We may terminate or restrict use for violations.
16. ERRORS, INACCURACIES & OMISSIONS
From time to time information on the Site may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct and to change or update information or cancel orders if any information is inaccurate, at any time (including after you submit your order) where permitted by law.
17. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Service and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, except where prohibited by law. To the fullest extent permitted, 19/99 Beauty and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits/revenue/data, arising from your use of the Service or products. In jurisdictions that do not allow limitations of liability, our liability shall be limited to the amount you paid for the product(s) giving rise to the claim or $100 USD, whichever is greater. Nothing limits liability for personal injury caused by our negligence, fraud, or other liabilities that cannot be limited by law. (New Jersey residents: certain limitations may not apply.)
18. INDEMNIFICATION
You agree to indemnify and hold harmless 19/99 Beauty and its affiliates, officers, agents, partners, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or third-party rights.
19. DISPUTE RESOLUTION; ARBITRATION; CLASS-ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. It affects your rights.
You and 19/99 Beauty agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by [AAA or JAMS] under its rules, rather than in court, except for (a) matters that qualify for small claims court and (b) claims for injunctive relief regarding IP rights. Class actions and class arbitrations are not permitted: you may bring claims only in your individual capacity. You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@1999beauty.com with subject line “Arbitration Opt-Out” and your name and address.
20. GOVERNING LAW; VENUE
These Terms and any separate agreements whereby we provide you Services are governed by the laws of the State of [Choose: New York / Delaware / California], without regard to conflict-of-laws rules. Subject to the arbitration clause above, exclusive venue lies in the state or federal courts located in [Chosen State & County], and you consent to personal jurisdiction there.

21. EXPORT CONTROLS & SANCTIONS
You may not use, export, or re-export products or content in violation of U.S. export laws or OFAC sanctions.
22. FORCE MAJEURE
We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, war, terrorism, epidemics, or governmental actions.
23. TERMINATION
These Terms remain effective until terminated by either party. You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms. Obligations incurred before termination (including payment obligations) survive termination.
24. SEVERABILITY; NO WAIVER
If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in effect. Our failure to enforce any right is not a waiver.
25. ENTIRE AGREEMENT
These Terms and any policies or rules posted on the Site constitute the entire agreement between you and us and supersede prior agreements. Any ambiguities are not construed against the drafting party.
